ON PUBLIC HOLIDAYS and OBSEVANCES

 

CHAPTER ONE

GENERAL PROVISIONS

Article 1.Purpose of the Law

1.1.The purpose of this Law is to determine public holidays and observances, and to regulate relations in connection with their celebration.

Article 2.Legislation on public holidays and observances

2.1.Legislation on public holidays and observances shall consist of the Constitution of Mongolia, the Law on Labor, the Law on National Festival Naadam, this Law and other legislative acts enacted in conformity therewith.

Article 3.Terms of the Law

3.1.The following terms used in this Law shall have the following meanings:

3.1.1."a public holiday" shall mean a day that is publicly rested and celebrated as a holiday throughout the country;

3.1.2."an observance" shall mean a day that is associated witha historical or specific event, involves a certain social class, and is an accustomed to be celebrated publicly.

CHAPTER TWO

PUBLIC HOLIDAYS AND OBSERVANCES AND THEIR CELEBRATION

Article 4.Public holidays

4.1.Public holidays shall be:

4.1.1.unless otherwise specified by law, the National Festival Naadam and the Anniversary of the Mongolian People's Revolution: 10th, 11th, 12th, 13th, 14th, 15th of July;

4.1.3.White moon days: the first three days of the first spring month according to the lunar calendar;

4.1.5.International Women's Day: 8th of March;

4.1.6.Children's Day: 1st of June;

4.1.7.National Freedom and Independence Day: 29th of December;

4.1.8.Genghis Khan's Day: Chinggis Khaan's birthday - the first day of the first winter month according to the lunar calendar;

4.1.10.Buddha's Day of the Great Dimension: 15th of the first summer month according to the lunar calendar.

Article 5.Observances

5.1.The following observances shall be celebrated throughout Mongolia:

5.1.1.Constitution Day of Mongolia: 13th of January;

5.1.2.Soldiers' Day of Mongolia: 18th of March;

5.1.3.Health Protection Day: 7th of April;

5.1.4.Intellectual property protection day: 26th of April;

5.1.5.Family Day: 15th of May;

5.1.6.Youth Day: 25th of August;

5.1.7.Memorial Day of political victims: 10th of September;

5.1.8.Environmental protection days: the fourth week of September;

5.1.9.Veteran's Day: 1st of October;

5.1.10.Capital City Day of Mongolia: 29th of October;

5.1.11.Democracy and Human Rights Day: 10th of December;

5.1.12.Patriot's Day: 1st of March;

5.1.13.New harvest days: from 5th of September to 20th of October;

5.1.15.National Flag Day of Mongolia: 10th of July;

5.1.17.National LiteraryCulture and books days: Saturday and Sunday of the third week of May and September.

5.2.Except the public holidays and observances, the Government shall determine the date of the anniversary, historical events, days of employees and workers of the sector and certain professions, and observances established to be celebrated worldwide by international organizations other than those specified in this Law.

Article 6.Celebrating public holidays and observances

6.1.State ceremonies may be organized to celebrate public holidays and observances. The procedure for the state ceremony shall be approved by the President of Mongolia.

6.2.Public holidays and observances shall be celebrated for less costly and no more than one day unless otherwise specified by law.

6.3.During public holidays and observances, the reward and prizes of contests and competitions to be financed from the state and local budgets shall be not higher than the prizes of the National Festival Naadam.

Article 7.Powers of state and local self-governing body

7.1.The Government shall approve the procedure for celebrating the holidays and observances specified in paragraph 5.2 of this Law and shall monitor the performance of the expenditure reflected in the budget.

7.2.The Citizens Representatives Khural of aimag and the Capital city shall determine the celebration date to be celebrated at the local level, other than those specified in Articles 4 and 5 of this Law, and shall approve the procedures and expenses for celebrating them.

7.3.Governors of aimag, soums, the Capital city, and districts shall organize celebrations of holidays and observances without exceeding the budgeted expenses.

CHAPTER THREE

MISCELLANEOUS

Article 8.Liabilities to be imposed on the violators of the Law

8.1.Officials who violate this Law shall be subject to liability specified in the Law on Civil Service.

8.2.Any person or legal entity who violates this Law shall be subject to liability specified in the Law on Violations.
