1 дүгээр зүйл.Үндсэн хуулийн цэцэд маргаан хянан шийдвэрлэх ажиллагааны зорилт

Үндсэн хуулийн цэцэд маргаан хянан шийдвэрлэх ажиллагааны зорилт нь Үндсэн хууль зөрчсөн тухай маргааныг бүх талаас нь бүрэн гүйцэд, бодитой хянан үзэж, магадлан шийдвэрлэж Үндсэн хуулийг чандлан сахиулах баталгааг хангахад оршино.

2 дугаар зүйл.Үндсэн хуулийн цэцэд маргаан хянан шийдвэрлэх ажиллагааны тухай хууль тогтоомж

Хэвлэх

Үндсэн хуулийн цэцэд /цаашид "Цэц" гэх/ маргаан хянан шийдвэрлэх ажиллагааны тухай хууль тогтоомж нь Үндсэн хууль, Үндсэн хуулийн цэцийн тухай хууль, энэ хууль болон тэдгээртэй нийцүүлэн гаргасан бусад хуулиас бүрдэнэ.

3 дугаар зүйл.Маргаан хянан шийдвэрлэх Цэцийн бүрэлдэхүүн

Хэвлэх

1.Цэцэд маргаан хянан шийдвэрлэх ажиллагааг хуулиар тогтоосон журмын дагуу томилогдсон Цэцийн гишүүд хэрэгжүүлнэ.

2.Цэцэд маргаан хянан шийдвэрлэх ажиллагааны бага суудал 3, дунд суудал 5, их суудал 7-9 гишүүний бүрэлдэхүүнтэй байна.

3.Цэцэд ирсэн өргөдөл, мэдээлэл, хүсэлтийг үндэслэн маргаан үүсгэх эсэх талаар Цэцийн гишүүний шийдвэрийн талаар гарсан гомдлыг З гишүүний бүрэлдэхүүнтэй; Цэцийн хуралдаанд оруулахаар маргаан үүсгэн шалгасан бүх асуудлыг анхлан шийдвэрлэх хуралдааныг 5 гишүүний бүрэлдэхүүнтэй; Цэцийн хуралдаанаас гаргасан дүгнэлтийг Улсын Их Хурал хүлээн зөвшөөрөөгүй, урьд шийдвэрлэсэн маргааны талаар шинэ учир байдал илэрсэн, Цэцийн нийт гишүүдийн олонхийн саналаар дахин хянаж эцэслэн шийдвэрлэх хуралдааныг бүрэн бүрэлдэхүүнтэй , хэрэв энэ тохиолдолд зарим гишүүн хүндэтгэн үзэх шалтгаанаар хуралдаанд оролцох боломжгүй бол Цэц маргааныг 7-гоос доошгүй гишүүний бүрэлдэхүүнтэй тус тус хийнэ.

4.Цэц энэ хуулийн 13 дугаар зүйлийн 2,3 дахь хэсэгт заасан албан тушаалтан Үндсэн хууль зөрчсөн эсэх, түүнийг огцруулах болон эгүүлэн татах үндэслэл байгаа эсэх асуудлыг их суудал буюу 7-9 гишүүний бүрэлдэхүүнтэй хянан шийдвэрлэнэ.

5.Хэлэлцэж байгаа асуудлыг Цэцийн хуралдаанд оролцсон гишүүдийн олонхийн саналаар шийдвэрлэнэ. Тухайн асуудлаар цөөнх болсон гишүүд үндэслэлээ тайлбарлаж дахин санал хураалгах эрхтэй бөгөөд хоёр дахь санал хураалтаар нөгөө тал цөөнх болж дахин санал хураалгах хүсэлт, тайлбар гарсан бол гурав дахь санал хураалт явуулж, эцэст нь хоёр удаа олонхийн санал авснаар асуудлыг шийдвэрлэнэ.

6.Цэц маргааныг дахин хянан үзэж, асуудлыг хуралдаанд оролцсон гишүүдийн гуравны хоёр хувийн саналаар эцэслэн шийдвэрлэнэ. Хэрэв гишүүдийн гуравны хоёр хувийн санал авч чадаагүй бол уг хууль, тогтоол, зарлиг, бусад шийдвэр, Монгол Улсын олон улсын гэрээний заалт хүчинтэй хэвээр үлдэнэ.

7.Зөвлөлдөх тасалгаанд олонхитой санал нийлээгүй гишүүн саналаа тусгайлан бичгээр гаргаж, Цэцийн шийдвэрт хавсаргана.

/Энэ хэсгийг 2016 оны 1 дүгээр сарын 19-ны өдрийн хуулиар өөрчлөн найруулсан/

4 дүгээр зүйл.Цэцэд маргааныг ил тод хянан шийдвэрлэх

Хэвлэх

1.Цэцэд маргаан хянан шийдвэрлэх ажиллагааг ил тод явуулна. Төрийн болон албаны нууц, байгууллагын нууц, хүний эмзэг мэдээллийг хамгаалах, иргэдийн аюулгүй байдлыг хангах онцгой шаардлагатайгаас бусад тохиолдолд Цэцийн хуралдааныг нээлттэй хийнэ.

/Энэ хэсэгт 2021 оны 12 дугаар сарын 17-ны өдрийн хуулиар өөрчлөлт оруулсан./

2.Цэцийн нээлттэй хуралдаанд оролцогчид хуралдааны танхимд тэмдэглэл, соронзон бичлэг, түүнчлэн радио, телевизийн шууд нэвтрүүлэг хийх, кино болон фото зураг авах, дүрс бичлэг хийхийг зөвшөөрнө.

3.Цэцийн шийдвэр болон нээлттэй хуралдааны тэмдэглэлийг иргэн, хуулийн этгээд өөрийн зардлаар хувилан авах эрхтэй.

5 дугаар зүйл.Цэцэд маргаан хянан шийдвэрлэх ажиллагааг үгчилж явуулах

Хэвлэх

Цэцийн хуралдаанд маргагч талуудын тайлбар, дүгнэлт, санал, хүсэлт, мэтгэлцээнийг үгээр сонсох бөгөөд шийдвэр гаргахад шаардлагатай болон маргагч талуудын хүссэн бичиг баримт, материалыг нэгбүрчлэн уншиж сонсгоно.

6 дугаар зүйл.Цэцэд маргаан хянан шийдвэрлэх ажиллагааны хэл

Хэвлэх

1.Цэцэд маргаан хянан шийдвэрлэх ажиллагааг монгол хэлээр явуулна.

2.Маргагч талууд монгол хэл мэдэхгүй бол түүнд хэлмэрчээр дамжуулан төрөлх буюу аль сайн мэдэх хэлээрээ ярих, ойлгох бололцоог Цэц олгоно. Хуралдаанд оролцож байгаа гэрч, шинжээч, бусад мэргэжилтэн монгол хэл сайн мэдэхгүй бол мэдүүлэг, дүгнэлт, тайлбараа төрөлх буюу сайн мэдэх хэлээрээ гаргаж хэлмэрчлүүлэх эрхтэй.

3.Цэцийн хуралдааны тэмдэглэл болон бусад бүх бичиг баримтыг монгол хэлээр бичиж, гадаад хэл дээрх бичиг баримтуудыг монгол хэлээр орчуулсан байна.

7 дугаар зүйл.Цэцэд маргаан хянан шийдвэрлэх ажиллагааг биечлэн явуулах

Хэвлэх

1.Маргааныг хянан шийдвэрлэх хуралдааныг хуулиар тогтоосон журмын дагуу томилогдсон бүрэлдэхүүнээр эхнээс нь дуусах хүртэл биечлэн явуулна.

2.Маргаан хянан шийдвэрлэх Цэцийн бүрэлдэхүүнд томилогдсон гишүүнийг хэн ч хуульд заасан үндэслэл, журмаас гадуур маргаан хянан шийдвэрлэх ажиллагаанаас татан гаргах эрхгүй.

3.Маргааныг хянан шийдвэрлэх Цэцийн бүрэлдэхүүнд оролцсон гишүүн хүндэтгэн үзэх шалтгаанаар үргэлжлүүлэн ажиллах боломжгүй бол түүний оронд Цэцийн өөр гишүүнийг нөхөн томилж хуралдааны ажиллагааг эхнээс нь дахин шинээр явуулна.

8 дугаар зүйл.Цэцэд маргаан хянан шийдвэрлэх ажиллагааг тасралтгүй явуулах

Хэвлэх

1.Цэцийн хуралдаан болон зөвлөлдөөн хууль тогтоомжид заасан амралтын цагаас бусад хугацаанд тасралтгүй явагдана.

2.Цэцийн хуралдаан гэрч, мэргэжилтэн, шинжээч дуудах, томилох, шинээр нотлох баримт бүрдүүлэх, хуралдаанд үргэлжлүүлэн ажиллах боломжгүй болсон гишүүний оронд өөр гишүүнийг нөхөн томилох зэрэг шалтгаанаар завсарлаж болно.

3.Цэцийн хуралдаан завсарласан хугацаанд өөр төрлийн маргаан хянан шийдвэрлэх ажиллагаа явуулж болохгүй.

4.Тухайн хуралдаанаар маргааныг хянан шийдвэрлэх боломжгүй нөхцөл, байдал үүсвэл уг нөхцөл, байдлыг арилгах боломжтой хугацаагаар маргаан хянан шийдвэрлэх ажиллагааг хойшлуулна.

5.Цэцийн хуралдааныг Цэцийн гишүүн солигдсон шалтгаанаар хойшлуулсан бол хуралдааныг эхнээс нь шинээр явуулна. Хуралдааны бусад оролцогчид өөрчлөгдсөн нь Цэцийн хуралдааныг хойшлуулсан үе шатнаас үргэлжлүүлэн явуулахад саад болохгүй.

9 дүгээр зүйл.Мэтгэлцэх

Хэвлэх

1.Цэцийн хуралдаанд маргагч талууд, тэдгээрийн итгэмжилсэн төлөөлөгч, өмгөөлөгчид маргаж байгаа асуудлаар харилцан бие биедээ асуулт тавьж, хариулт авах, гомдлын шаардлага, татгалзлалын үндэслэл болсон нотлох баримтуудыг харилцан няцаах, энэ талаархи баримтуудыг зохих журмын дагуу гаргах, батлах зэргээр мэтгэлцэх эрхээ хэрэгжүүлнэ.

2.Цэц төвийг сахиж, маргагч талуудад чөлөөтэй мэтгэлцэх бололцоо олгоно.

10 дугаар зүйл.Цэцийн гишүүд зөвлөлдөх

Хэвлэх

1.Цэцийн шийдвэр гаргах гишүүдийн зөвлөлдөөнийг тусгай тасалгаанд хийнэ.

2.Цэцийн зөвлөлдөх тасалгаанд хуралдааны бүрэлдэхүүнд орсон гишүүд, зөвлөлдөөний тэмдэглэл хөтлөх хуралдааны нарийн бичгийн даргаас өөр хүн орохыг хориглоно. Зөвлөлдөх тасалгаанд гаргасан гишүүний санал Цэцийн шийдвэрийн үндэслэл болсон бол шийдвэрийн үндэслэл хэсэгт бичигдэх бөгөөд тусгай санал гаргасан гишүүний саналыг Цэцийн шийдвэрт хавсаргана.

/Энэ хэсгийн "тусгай санал гаргасан гишүүний саналыг Цэцийн шийдвэрт хавсаргана." гэснийг Үндсэн хуулийн цэцийн 2016 оны 06 дугаар сарын 17-ны өдрийн 04 дүгээр тогтоолоор хүчингүй болгосон/

11 дүгээр зүйл.Цэцийн шийдвэр хууль ёсны, үндэслэлтэй байх

Хэвлэх

1.Цэц шийдвэрээ Монгол Улсын Үндсэн хуулийн нэрийн өмнөөс гаргана.

2.Цэцийн шийдвэр нь Үндсэн хууль, Үндсэн хуулийн цэцийн тухай хууль болон энэ хуулийн холбогдох заалтын үг үсэг, утга санаанд бүрэн нийцсэн нөхцөлд хууль ёсны болно. Цэц болон Цэцийн гишүүн Үндсэн хууль болон Үндсэн хуулийн цэцийн тухай хуулийн заалттай харшлаагүй бусад хуулийн заалтыг удирдлага болгож болно.

3. Маргааныг шийдвэрлэхэд ач холбогдол бүхий нөхцөл байдлуудыг хуралдааны үед бүх талаас нь бүрэн гүйцэд, бодитой хянан үзэж, гарах дүгнэлтийг нотлох баримтуудаар хангалттай баталсан нөхцөлд Цэцийн шийдвэр үндэслэлтэй болно.

4.Цэцийн эцсийн шийдвэр нь гармагц хүчин төгөлдөр болно.

12 дугаар зүйл.Цэцэд маргаан хянан шийдвэрлэх ажиллагаа хараат бус байх

Хэвлэх

1.Маргааныг хянан шийдвэрлэх ажиллагаа явуулж байгаа Цэцийн гишүүн аливаа байгууллага, албан тушаалтан, бусад иргэнээс хараат бус байж, гагцхүү Үндсэн хуульд захирагдан, дотоод итгэлээрээ асуудлыг шийдвэрлэнэ.

2.Цэцийн гишүүн албан үүргээ гүйцэтгэхдээ аль нэг этгээдийг төлөөлөхгүй.

3.Албан тушаалтан, иргэн хэн боловч Цэцийн гишүүнээс маргаан хянан шийдвэрлэх үүргээ хэрэгжүүлэхэд хөндлөнгөөс оролцох, шахалт дарамт үзүүлэх, бусад хэлбэрээр нөлөөлөхийг хориглоно.

4.Цэцийн гишүүн хянан шалгаж байгаа маргааны талаархи саналаа урьдчилан хэлэх, энэ талаар бусдад зөвлөгөө өгөх эрхгүй.

13 дугаар зүйл.Маргааны харьяалал

Хэвлэх

1.Цэц Үндсэн хуулийг зөрчсөн эсэх тухай дор дурдсан маргааныг хянаж дүгнэлт гаргах бөгөөд шаардлагатай бол дахин хянаж, эцэслэн шийдвэрлэнэ:

1/Монгол Улсын Үндсэн хууль, түүнд оруулсан нэмэлт, өөрчлөлтөөс бусад хууль, Улсын Их Хурлын бусад шийдвэр;

/Энэ заалтад 2022 оны 8 дугаар сарын 24-ний өдрийн хуулиар нэмэлт оруулсан./

2/Монгол Улсын Ерөнхийлөгчийн зарлиг, бусад шийдвэр;

3/Засгийн газрын шийдвэр;

4/Монгол Улсын олон улсын гэрээ;

5/ард нийтийн санал асуулга, Улсын Их Хурал, түүний гишүүний болон Ерөнхийлөгчийн сонгуулийн талаар сонгуулийн төв байгууллагын гаргасан шийдвэр.

2.Цэц дор дурдсан албан тушаалтан Үндсэн хууль зөрчсөн эсэх тухай асуудлаар гарсан маргааныг хянаж дүгнэлт гаргана:

1/Монгол Улсын Ерөнхийлөгч;

2/Улсын Их Хурлын дарга;

3/Улсын Их Хурлын гишүүн;

4/Ерөнхий сайд;

5/Засгийн газрын гишүүн;

6/Улсын Дээд шүүхийн Ерөнхий шүүгч;

7/Улсын ерөнхий прокурор.

З. Цэц дор дурдсан албан тушаалтнуудыг огцруулах болон эгүүлэн татах, Улсын Их Хурлын гишүүн бүрэн эрхээ хэрэгжүүлэхдээ өргөсөн тангаргаасаа няцсан гэх үндэслэл байгаа эсэх талаар дүгнэлт гаргана:

1/Монгол улсын ерөнхийлөгч

2/Улсын Их Хурлын дарга;

3/Ерөнхий сайд;

4/Улсын Их Хурлын гишүүн.

4.Цэцэд ирүүлсэн маргааны шаардлагын зарим нь Цэцэд, зарим нь өөр шүүх буюу бусад байгууллагад харьяалалтай байвал Цэц зөвхөн өөрийн харьяалалтай маргааны шаардлагыг шийдвэрлээд бусдын харьяалах маргааны шаардлагыг шийдвэрлэхээс татгалзана. Энэ нь тэр маргааныг харьяалах байгууллагаас хянан шийдвэрлэх ажиллагаанд саад болохгүй.

14 дүгээр зүйл.Хэргийн харьяалал тогтоох

Хэвлэх

Аль ч шүүх авч хэлэлцэхгүй байгаа эрх зүйн маргааны хэргийн харьяаллыг тогтоолгохоор иргэн, албан тушаалтан, төр, олон нийтийн байгууллага Үндсэн хуулийн цэцэд гомдол гаргавал хэргийн харьяаллыг тогтоож холбогдох шүүхэд шилжүүлнэ.

15 дугаар зүйл.Цэцэд маргаан хянан шийдвэрлэх ажиллагааны хүрээ

Хэвлэх

1.Цэц нь Үндсэн хуулийн биелэлтэд дээд хяналт тавьж түүнийг зөрчсөн эсэх тухай маргааныг хянан шийдвэрлэнэ.

2.Үндсэн хуулиас бусад хуулийг зөрчсөн эсэх тухай маргааныг Цэц харьяалан шийдвэрлэхгүй.

3.Цэц маргаан хянан шийдвэрлэх ажиллагааг зөвхөн өргөдөл, мэдээлэл, хүсэлтээр үүсгэн явуулна.

Хэрэв эрх бүхий байгууллага, албан тушаалтан шийдвэр гаргахдаа Цэцийн шийдвэрээр хүчингүй болсон хууль болон бусад шийдвэрийн заалтыг шууд буюу агуулгаар нь дахин сэргээвэл Цэцийн аль нэг гишүүний санаачилгаар Цэц хяналтын журмаар хянан шийдвэрлэж болно.

4.Цэц зөвхөн Үндсэн хууль хүчин төгөлдөр болж үйлчилсэн 1992 оны 2 дугаар сарын 12-ны өдрөөс хойш гарсан хууль тогтоомж болон албан тушаалтны үйл ажиллагаатай холбогдсон маргааныг хянан шийдвэрлэнэ.

/Үндсэн хуулийн цэцийн 2020 оны 04 дүгээр сарын 15-ны өдрийн 01 дүгээр дүгнэлтээр "Цэц зөвхөн Үндсэн хууль хүчин төгөлдөр болж үйлчилсэн 1992 оны 2 дугаар сарын 12-ны өдрөөс хойш гарсан хууль тогтоомж болон албан тушаалтны үйл ажиллагаатай холбогдсон маргааныг хянан шийдвэрлэнэ." гэснийг 2020 оны 04 дүгээр сарын 15-ны өдрөөс эхлэн түдгэлзүүлсэн./

/Монгол Улсын Их Хурлын 2020 оны 04 дүгээр сарын 24-ний 30 дугаар тогтоолоор Үндсэн хуулийн цэцийн 2020 оны 04 дүгээр сарын 15-ны өдрийн 01 дүгээр дүгнэлтийг хүлээн зөвшөөрөх боломжгүй гэж үзсэн./

16 дугаар зүйл.Цэцэд өргөдөл, мэдээлэл, хүсэлт гаргах

Хэвлэх

1.Үндсэн хууль зөрчсөн эсэх асуудлаар өргөдөл, мэдээллийг иргэд; хүсэлтийг Ерөнхийлөгч, Улсын Их Хурал, Ерөнхий сайд, Улсын дээд шүүх, Улсын ерөнхий прокурор гаргах эрхтэй.

2.Цэцэд өргөдөл, мэдээлэл гаргах эрхийг Монгол Улсын иргэдээс гадна Монгол Улсын нутаг дэвсгэрт хууль ёсоор оршин суугаа гадаад улсын иргэн, харьяалалгүй хүн эдэлнэ.

17 дугаар зүйл.Цэцэд маргаан хянан шийдвэрлэх ажиллагаанд оролцогч

Хэвлэх

1.Цэцэд маргаан хянан шийдвэрлэх ажиллагаанд оролцогч нь:

1/Цэцийн маргаан хянан шийдвэрлэх ажиллагааг үүсгэх өргөдөл, мэдээлэл, хүсэлт гаргасан иргэд, эрх бүхий албан тушаалтан, байгууллага, түүнчлэн Үндсэн хууль зөрчсөн гэж маргаан үүсгэсэн хууль, бусад шийдвэрийг гаргасан буюу үйл ажиллагаа явуулсан байгууллага, албан тушаалтан;

2/албан тушаалын байдлаар буюу зохих журмын дагуу томилогдсон итгэмжилсэн төлөөлөгч, өмгөөлөгч байна.

2.Цэцэд маргаан хянан шийдвэрлэх ажиллагаанд оролцох итгэмжилсэн төлөөлөгч нь Иргэний хэрэг шүүхэд хянан шийдвэрлэх тухай хуульд заасан журмын дагуу томилогдсон байна.

18 дугаар зүйл.Цэцэд маргаан хянан шийдвэрлэх ажиллагаанд оролцогчдын эрх, үүрэг

Хэвлэх

1.Цэцэд маргаан хянан шийдвэрлэх ажиллагааны оролцогчид нь тус тусын бүрэн эрхийн хүрээнд адил тэгш эрх эдэлнэ.

2.Маргагч талууд Цэцэд хянаж байгаа маргааны материалтай танилцах, холбогдох баримт бичгийг хуулбарлан авах, тэмдэглэл хийх, нотлох баримтыг гаргаж өгөх, нотлох баримтыг шинжлэн судлах ажиллагаанд оролцох, хянан шийдвэрлэх ажиллагааны явцад гарсан бүх асуудлын талаар өөрийн санал, дүгнэлтийг гаргах, маргаан хянан шийдвэрлэх хуралдаанд чөлөөтэй мэтгэлцэх, шаардлагатай гэж үзэж байгаа бол төгсгөлийн үг хэлэх, хүсэлт тавих болон Цэцийн хуралдааны тэмдэглэлийг авах эрхтэй. Маргагч тал хүсвэл Цэц хуралдааны тэмдэглэлээ цаас болон дууны, дүрсний, дуу-дүрсний бичлэг болон цахим хэлбэрээр гарган өгнө.

3.Оролцогч талууд Цэцийн хуралдааны бүрэлдэхүүнээс татгалзан гаргах саналыг хуульд заасан үндэслэлийн дагуу тавих эрхтэй.

4.Цэцэд өргөдөл, мэдээлэл, хүсэлт гаргасан тал хянаж байгаа асуудлын хүрээнд Цэцийн хуралдаан зөвлөлдөхөөр завсарлахаас өмнө аль ч шатанд өөрийн шаардлагын үндэслэл, зүйлийг өөрчлөх, хэмжээг ихэсгэх, багасгах болон шаардлагаас бүхэлд нь буюу зарим хэсгээс нь татгалзах эрхтэй.

5.Маргаан хянан шалгах ажиллагаанд оролцож байгаа маргагч талууд өөрсдийн шаардлагын үндэслэл болон сөрөг шаардлагыг эсэргүүцэж байгаа үндэслэлээ батлах бичиг баримтыг бүрдүүлж, нөхцөл байдлыг нотлох үүрэгтэй.

6.Маргаан хянан шалгах ажиллагаанд оролцогч Цэцийн хуралдааны дэгийг чанд сахих, хуралдаан даргалагчид захирагдах үүрэгтэй.

7.Маргаан хянан шалгах ажиллагаанд оролцогч Цэцийн хуралдааны дэгийг дахин зөрчих, Цэц болон түүний гишүүдэд хуурамч бичиг баримт өгвөл Цэцийг хүндэтгээгүй үйлдэл гэж үзэж зохих хуульд заасан хариуцлага хүлээлгэнэ.

19 дүгээр зүйл.Цэцэд маргаан хянан шийдвэрлэх ажиллагааны зардал

Хэвлэх

1.Цэцэд маргаан хянан шийдвэрлэх ажиллагаанд оролцсон гэрч, шинжээч, мэргэжилтэн, орчуулагчийн болон бусад шаардлагатай зардлыг улсын төсвөөс төлнө.

2.Цэцэд маргаан хянан шалгах ажиллагааг үүсгэх үндэслэл болсон өргөдөл, мэдээлэл гаргасан иргэн орон нутагт оршин суудаг бол түүнийг Цэцийн хуралдаанд оролцсонтой холбогдсон зардлыг:

1/уг иргэний өргөдөл, мэдээлэл үндэслэлтэй гэж тогтоогдсон бол Үндсэн хууль зөрчсөн хууль, зарлиг, бусад шийдвэр гаргасан байгууллага, албан тушаалтан буюу Үндсэн хууль зөрчсөн албан тушаалтан;

2/хэрэв өргөдөл, мэдээлэл нь үндэсгүй болж тогтоогдсон бол уг иргэн өөрөө хариуцна.

ХОЁРДУГААР БҮЛЭГ
ЦЭЦЭД МАРГААН ХЯНАН ШИЙДВЭРЛЭХ АЖИЛЛАГААГ ҮҮСГЭХ, ХУРАЛДААНД БЭЛТГЭХ

20 дугаар зүйл.Цэцэд өргөдөл, мэдээлэл, хүсэлт гаргах

Хэвлэх

1.Иргэн, байгууллага, албан тушаалтан Цэцэд өргөдөл, мэдээлэл, хүсэлтээ бичгээр, эсхүл цахим хэлбэрээр гаргах бөгөөд түүнд дараахь зүйлийг тусгана:

/Энэ хэсэгт 2024 оны 01 дүгээр сарын 12-ны өдрийн хуулиар нэмэлт оруулсан./

1/өөрийн нэр, хаяг, оршин суугаа газар, харилцах хэлбэр;

2/түүний итгэмжилсэн төлөөлөгч буюу өмгөөлөгчөөр оролцох хүний нэр, хаяг, албан тушаал, бусад шаардлагатай мэдээлэл;

3/Үндсэн хуульд нийцээгүй гэж үзэж байгаа хууль тогтоомжийн нэр, батлан гаргасан он, сар, өдөр, дугаар, түүнчлэн Үндсэн хууль зөрчсөн гэж үзэж байгаа албан тушаалтны нэр, хаяг үйл ажиллагааны талаар;

4/өөрийн шаардлагын үндэслэл, бусад нөхцөл байдал, тэдгээрийн нотолгоо;

5/маргаж байгаа асуудлын талаархи өөрийн байр суурь;

6/Цэцээр шийдвэрлүүлэхээр тавьж байгаа шаардлага;

7/Үндсэн хууль болон энэ хуулийн ямар зүйл, хэсэг, заалтыг үндэслэн Цэцэд хандаж байгаа;

8/хавсаргасан бичиг баримт болон холбогдох хүмүүсийн нэрсийн жагсаалт, тодорхой хаяг.

2.Маргаан хянан шийдвэрлэх ажиллагаанд өргөдөл, мэдээлэл, хүсэлт гаргасан этгээдийн итгэмжилсэн төлөөлөгч оролцох бол итгэмжлэл, түүнчлэн монгол хэлээс өөр хэл дээрх бичиг баримт хавсаргаж байгаа бол түүний орчуулгыг заавал хавсаргана.

3.Цэц нэргүй өргөдөл, мэдээлэл, хүсэлтийг хүлээж авахгүй.

21 дүгээр зүйл.Цэцэд өргөдөл, мэдээлэл хүсэлтийг хүлээн авах

Хэвлэх

1.Иргэн, байгууллага, албан тушаалтнаас Цэцэд гаргасан өргөдөл, мэдээлэл, хүсэлтийг Цэцийн дарга уг асуудлыг хянан шалгах гишүүнд хуваарилна.

2.Үндсэн хууль зөрчсөн тухай иргэнээс гаргасан өргөдөл, мэдээллийг хүлээн авсан гишүүн анхны шалгалтыг 14 хоногийн дотор хийж маргаан үүсгэх эсэхийг өөрийн санаачилгаар шийдвэрлэнэ.

3.Цэцэд хандах эрх бүхий байгууллага, албан тушаалтнаас гаргасан хүсэлтийг хүлээн авсан Цэцийн гишүүн маргаан шууд үүсгэж шалгана.

4. Цэцэд маргаан хянан шийдвэрлэх ажиллагаа үүсгэх эсэх талаархи Цэцийн гишүүний шийдвэрийг маргагч талууд эс зөвшөөрч гомдол бичгээр, эсхүл цахим хэлбэрээр гаргасан бол Цэцийн даргын тогтоолоор томилсон З гишүүний бүрэлдэхүүнтэй хуралдаанаар хянан хэлэлцэж, маргаан хянан шийдвэрлэх ажиллагаа үүсгэх эсэхийг шийдвэрлэж магадлал гаргана.

/Энэ хэсгийн "... буюу Цэцийн аль нэг гишүүн ..., санал ..." гэснийг Үндсэн хуулийн цэцийн 2021 оны 5 дугаар сарын 28-ны өдрийн 6 дугаар дүгнэлтээр 2021 оны 5 дугаар сарын 28-ны өдрөөс эхлэн түдгэлзүүлсэн./

/Монгол Улсын Их Хурлын 2021 оны 6 дугаар сарын 11-ний өдрийн 46 дугаар тогтоолоор хүлээн зөвшөөрсөн./

5.Цэцийн гишүүн иргэнээс гаргасан өргөдөл, мэдээллийг урьдчилан шалгаж дор дурдсан үндэслэл байвал маргаан хянан шийдвэрлэх ажиллагаа үүсгэхээс татгалзаж тогтоол гаргана:

1/өргөдөл, мэдээлэл нь энэ хуулийн 20 дугаар зүйлийн 1 дэх хэсэгт заасан шаардлагыг хангаагүй;

2/өргөдөл, мэдээлэл гаргагч нь Цэцэд хандах эрх бүхий этгээд биш;

3/өргөдөл, мэдээллээр тавьсан шаардлага Цэцийн харьяалан шийдвэрлэх маргаан биш;

4/уг маргааны талаар Цэцийн урьд гаргасан дүгнэлт, тогтоол хүчинтэй байгаа.

22 дугаар зүйл.Цэцийн гишүүн татгалзан гарах

Хэвлэх

1.Цэцийн гишүүнийг энэ хуульд зааснаас өөр үндэслэлээр маргаан хянан шийдвэрлэх ажиллагаанаас татгалзан гаргаж үл болно.

2.Төвийг сахих зарчмыг хангах үүднээс Цэцийн гишүүн дараах үндэслэл байвал маргаан хянан шийдвэрлэх ажиллагаанаас татгалзан гарна:

1/хянан хэлэлцэж байгаа асуудлыг урьд өмнө шүүхийн болон захиргааны журмаар хянан шийдвэрлэхэд оролцож байснаас хойш 2 жил өнгөрөөгүй бол;

2/маргагч талууд, тэдгээрийн төлөөлөгчидтэй ойрын төрөл садан бол;

3/Монгол Улсын Үндсэн хуулийн цэцийн тухай хуулийн 3 дугаар зүйлийн 7 дахь хэсгийг зөрчсөн гэх үндэслэл байгаа бол.

3.Энэ зүйлийн 2 дахь хэсэгт заасан үндэслэл байвал Цэцийн гишүүн энэ тухай өөрөө мэдэгдэж маргаан хянан шийдвэрлэх ажиллагаанаас татгалзан гарах үүрэгтэй. Маргагч талууд дээрх үндэслэлээр Цэцийн гишүүнийг татгалзан гаргах хүсэлт тавих эрхтэй.

4.Цэцийн гишүүн маргаан хянан шийдвэрлэх ажиллагаанаас татгалзан гарах асуудлыг Цэцийн хаалттай хуралдаанаар хэлэлцэж магадлал гаргана.

5.Маргааныг шалгасан Цэцийн гишүүн татгалзан гарвал уг маргааныг хянан шийдвэрлэх ажиллагааг шинээр эхэлнэ.

Цэцийн хуралдаанд оролцсон Цэцийн бусад гишүүдээс татгалзан гарвал хуралдааныг эхнээс нь явуулна.

23 дугаар зүйл.Цэцийн хуралдаанд бэлтгэх

Хэвлэх

1.Маргаан хянан шийдвэрлэх ажиллагаа үүсгэн шалгаж байгаа гишүүн уг маргааныг Цэцийн хуралдаанд хэлэлцүүлэхээр дараахь ажиллагааг хийнэ:

1/маргагч талуудад өргөдөл, мэдээлэл, хүсэлт, гомдлын, хуулбарыг гардуулж, маргаанд оролцох итгэмжилсэн төлөөлөгчөө томилох тухай мэдэгдэх;

2/маргагч талуудад энэ хуульд заасан эрх, үүргийг танилцуулж, Цэцэд шинээр нотлох баримт гаргахад нь туслах;

3/маргагч талууд болон тэдгээрийн итгэмжилсэн төлөөлөгчийг асууж, тайлбар, тодорхойлолт гаргуулах;

4/маргааныг шийдвэрлэхэд ач холбогдолтой бичиг баримт, бусад мэдээллийг шаардан гаргуулах;

5/маргаантай холбогдол бүхий албан тушаалтан бусад хүмүүсийг асууж тодорхойлолт авах;

6/шаардлагатай бол эрдэмтэн, мэргэжилтэн оролцуулах, тусгай мэргэжлийн шинжээч томилон ажиллуулах, дүгнэлт гаргуулах;

7/гэрчээс тодорхойлолт авах;

8/нэг асуудлаар хоёр буюу хэд хэдэн өргөдөл, мэдээлэл, хүсэлт байгаа бол тэдгээрийг нэгтгэх, нэг өргөдөл, мэдээлэл, хүсэлтэд хоёр буюу хэд хэдэн өөр шаардлага тавьсан бол тэдгээрийг тусгаарлах тогтоол гаргах;

9/маргагч талууд харилцан ойлголцож өргөдөл, мэдээлэл, хүсэлт гаргасан тал нь шаардлагаасаа сайн дураараа татгалзвал маргаан хянан шийдвэрлэх ажиллагааг татгалзах тогтоол гаргах;

10/цугларсан бичиг баримтад үндэслэн Цэцийн хуралдааны шийдвэрийн тэмдэглэх, тодорхойлох хэсгийн төслийг бэлтгэх;

11/маргааныг бүрэн гүйцэд, бодитой шийдвэрлэхэд шаардагдах бусад бэлтгэл ажиллагаа.

2.Маргаан хянан шийдвэрлэх ажиллагааг үүсгэснээс хойш хуралдаанд бэлтгэх ажиллагааг 30 хоногийн дотор гүйцэтгэх бөгөөд маргаан ээдрээ, төвөгтэй шалтгаанаар дээрхи хугацаанд дуусахгүй бол Цэцийн дарга 30 хүртэл хоногоор сунгаж болно.

3.Онц болон дайны байдал зарласан, түүнчлэн цэрэг хөдөлгөх шийдвэртэй холбогдсон маргааныг хянан шийдвэрлэх бэлтгэл ажиллагааг 3 хоногийн дотор гүйцэтгэнэ.

4.Онц хүндрэлтэй, яаралтай шийдвэрлэх асуудлыг хянан хэлэлцэх хуралдааны бэлтгэлийг хангахын тулд Цэцийн даргын тогтоолоор хоёр буюу хэд хэдэн гишүүнийг томилон ажиллуулж болно.

5.Байгууллага, албан тушаалтан, иргэн Цэцийн гишүүний шаардсан бичиг баримтыг хугацаанд нь гаргаж өгөх үүрэгтэй.

24 дүгээр зүйл.Цэцийн хуралдааныг зарлах

Хэвлэх

1.Цэцийн гишүүн маргааныг Цэцийн хуралдаанд хэлэлцүүлэх бэлтгэл ажиллагааг дууссан гэж үзвэл түүнийг Цэцийн хуралдаанаар хэлэлцүүлэхээр шилжүүлэх тухай тогтоол гаргана.

2.Цэцийн хуралдааныг нээлттэй хийнэ. Улсыг батлан хамгаалах, үндэсний аюулгүй байдал, Төрийн болон албаны нууцын тухай хууль, Байгууллагын нууцын тухай хууль, Хүний хувийн мэдээлэл хамгаалах тухай хуулиар тогтоосон нууц, хүний эмзэг мэдээлэлтэй холбоотой асуудлыг Цэцийн хаалттай хуралдаанаар хэлэлцэх бөгөөд маргааныг Цэцийн хуралдаанаар хэлэлцүүлэхээр шилжүүлэх тогтоолд энэ тухай заана.

3.Цэцийн гишүүн нь хуралдааныг нээлттэй буюу хаалттай хийх, мөн Цэцийн даргатай зөвшилцөн хуралдаан болох газар, өдөр, цагийг товлож энэ хуулийн 2З дугаар зүйлийн З дахь хэсэгт зааснаас бусад тохиолдолд 7 хоногийн өмнө төрийн төв хэвлэлд нийтэлж зарлана.

4.Маргагч талууд, гэрч, шинжээч болон бусад оролцогчдод Цэцийн хуралдаан болох газар, өдөр, цагийг албан ёсоор мэдэгдэнэ.

25 дугаар зүйл.Цэцийн хуралдаанд хүндэтгэл үзүүлэх

27 дугаар зүйл.Цэцийн хуралдаанд оролцогч тал хүрэлцэн ирээгүйн холбогдол

Хэвлэх

1.Маргагч тал болон гэрч, шинжээч, мэргэжилтэн, орчуулагч Цэцийн хуралдаанд хүрэлцэн ирээгүй бол түүний шалтгааныг тодруулна.

3.Маргагч тал хүндэтгэн үзэх шалтгаанаар хуралдаанд хүрэлцэн ирээгүй бөгөөд өөрөө заавал биечлэн оролцох хүсэлтээ албан ёсоор мэдэгдсэн бол хуралдааныг хойшлуулах тухай магадлал гаргаж, түүнд уг хуралдааныг хийх хугацааг заах буюу тийм боломжгүй бол дараа зарлахаар тогтооно.

4.Гэрч, шинжээч, мэргэжилтэн, орчуулагч хүрэлцэн ирээгүй бол хуралдааны хийх эсэхийг тухай бүр хэлэлцэн шийдвэрлэнэ.

28 дугаар зүйл.Цэцийн хуралдаанд маргаан хянан хэлэлцэх

Хэвлэх

1.Цэцийн хуралдаанд маргаан хянан хэлэлцэх ажиллагаа уг маргааныг урьдчилан шалгасан Цэцийн гишүүний илтгэлийг сонссоноор эхэлнэ.

Цэцийн гишүүн илтгэлдээ маргааны гол агуулга, түүнтэй холбоотой нотлох баримтыг өөрийн урьдчилсан дүгнэлт,  саналгүйгээр  танилцуулна.

2.Гишүүний илтгэлийг сонссоны дараа хуралдаанд маргагч талуудаас нэмэлт тайлбар байгаа бол өргөдөл, мэдээлэл, хүсэлт гаргасан талаас эхэлж ээлж дараалан сонсоно.

3.Нотлох баримтыг шинжлэн судлах, гэрч, шинжээч, мэргэжилтнүүдийн мэдүүлэг, дүгнэлт сонсох ажиллагаа явуулах бөгөөд дарааллыг хянан хэлэлцэж байгаа маргаан тус бүрийн онцлогийг харгалзан хуралдаан даргалагч тогтооно.

4.Оролцогч талууд харилцан мэтгэлцэх бөгөөд ээлж дарааллыг хуралдаан даргалагч тогтооно.

5.Цэцийн бүрэлдэхүүнд орсон гишүүд хуралдааны аль ч шатанд хуралдаан даргалагчийн зөвшөөрөлтэйгээр хэнээс боловч асуулт тавьж, хариулт авах эрхтэй. Цэцийн гишүүний асуулт нь урьдчилсан дүгнэлтийн агуулгатай, мэтгэлцэх хэлбэртэй байж болохгүй.

6.Бүх нотлох баримтыг шалгаж, мэтгэлцээн, асуулт, хариулт дууссаны дараа маргагч талуудад төгсгөлийн үг хэлж, хүсэлт гаргах санал байгаа бол сонсоно. Дараа нь шийдвэр гаргахаар Цэцийн хуралдаан завсарлаж байгааг хуралдаан даргалагч зарлана.

7.Цэцийн хуралдааны явцад маргааныг нэгтгэх, тусгаарлах асуудал гарвал, энэ тухай магадлал гаргана.

29 дүгээр зүйл.Цэц шийдвэр гаргахаар зөвлөлдөх

Хэвлэх

1.Цэц шийдвэрээ зөвлөлдөх тасалгаанд гаргана. Цэцийн шийдвэрийг хуралдаанд оролцсон аль нэг гишүүн бичнэ.

2.Зөвлөлдөх тасалгаанд асуудал шийдвэрлэхэд Цэцийн хуралдаанд оролцсон гишүүн бүр адил тэгш эрхтэй бөгөөд тухайн шийдэх гэж байгаа асуудлын талаар өөрийн санал, байр сууриа чөлөөтэй илэрхийлж, тайлбарлах эрхтэй.

3.Цэцийн шийдвэрийг тухайн хуралдаанд оролцсон гишүүд зөвлөлдөх тасалгаанд хэлэлцэж гаргахдаа уг маргааныг хуралдаанд илтгэсэн гишүүн өөрийн санал, дүгнэлтийг эхэлж гаргах бөгөөд түүний дараа хуралдаанд оролцсон гишүүдийн Цэцэд хамгийн удаан жил ажилласан гишүүнээс эхлэн ажилласан жилийн эрэмбээр санал, дүгнэлтээ хэлж, хуралдаан даргалагч эцэст нь саналаа гаргана.

4.Цэцийн хуралдаанд оролцсон гишүүн зөвлөлдөх тасалгаанд асуудал шийдвэрлэхэд саналаа заавал өгнө.

5.Цэц зөвлөлдөх тасалгаанд шийдвэрээ гаргасны дараа хуралдаан даргалагч болон бусад гишүүд бүгд гарын үсэг зурж, хуралдаан даргалагч буюу түүний даалгаснаар аль нэг гишүүн нийтэд уншиж сонсгоно.

6.Цэцийн хуралдаанд оролцсон гишүүдийн санал тэнцсэн, маргааны талаар нэмэлт шалгалт хийх шаардлагатай болсон бол Цэц уг маргааныг 30 хоногийн дотор дахин хянан хэлэлцэж шийдвэрлэхээр хойшлуулж, энэ тухай магадлал гаргана.

30 дугаар зүйл.Маргааныг дахин хянан шийдвэрлэх

Хэвлэх

1.Маргааныг дараахь үндэслэлээр хуралдаанд бэлтгэх шатнаас эхлэн дахин хянан шийдвэрлэнэ:

1/Цэцийн дүгнэлтийг Улсын Их Хурал хүлээн зөвшөөрөөгүй;

2/урьд шийдвэрлэсэн маргааныг дахин хянан шийдвэрлэх талаар Цэцийн гишүүдийн олонхи санал гаргасан;

3/шинэ нөхцөл байдал илэрсэн.

2.Цэцийн дарга маргааныг дахин хянан шийдвэрлэх тухай тогтоол гаргана.

3.Маргааныг дахин хянан шийдвэрлэхэд энэ хуульд заасан журмыг баримтлах бөгөөд харин уг маргааныг урьд нь шалгасан Цэцийн гишүүн дахин шалгаж болохгүй.

CHAPTER ONE.

THE BASIC RULES OF CONSTITUTIONAL PROCEDURE

Article 1. The objective of Examining and Resolving Disputes by the Constitutional Court /Tsets/ of Mongolia

The objective of examining and resolving disputes by the Constitutional Court /Tsets/ of Mongolia is to guarantee strict adherence to the Constitution through resolution of disputes upon complete, accurate and objective examination of all claims concerning a breach of the Constitution.

Article 2. Legislation on Examining and Resolving Disputes by the Constitutional Tsets

Legislation regulating examination and resolution of disputes by the Constitutional Tsets /hereinafter referred to as the "Tsets"/ of Mongolia shall consist of the Constitution, the Law on the Constitutional Tsets, this Law and other legislation enacted in conformity with the above laws.

Article 3. Dispute Resolution Composition of Tsets

1. Examination and dispute resolution shall be conducted by the Members of Tsets, appointed in accordance with the rules determined by law.

2. The Constitutional Tsets shall have a small bench consisting of 3, a medium bench of 5, and a full bench of 7-9 members as composition to examine and deliver the Constitutional Tsets decisions on constitutional disputes.

3. Complaints concerning a decision of a Member of Tsets on initiating/not initiating proceedings based on petitions, information and requests addressed to the Tsets shall be considered by a session of a 3-member bench; first decision on all issues examined for dispute resolution by a Tsets session shall be delivered by a 5-member bench; a full bench or in case of justified inability of some members to attend the session, a no less than 7-member bench shall discuss and deliver final decision on reconsidered cases of Tsets judgments rejected by the State Great Hural, or new circumstances arising on a previously settled dispute or judgments petitioned by the majority of members of Tsets for reconsideration and final decision.

4. A full bench of 7-9 members of the Tsets shall examine and deliver a decision on the substance of breach of the Constitution and existence of grounds for resignation or recall an official specified in Article 13, Section 2 and 3 of this Law.

5. Issues under consideration shall be decided by a majority vote of the members sitting in the session. Members in the minority vote on a given issue are entitled to petition for a revote providing justification and grounds. In the case the revote reverses the majority into minority and a request for revote is put forward there shall be a third voting, and the resolution shall contain the opinion which gained the majority vote twice.

6. A judgment of the Tsets under reconsideration shall be decided by a two-third majority vote of members sitting in the session. If the two-third majority vote is not achieved the contested provision of a law, resolution, decree or other decisions, an international treaty of Mongolia shall remain in force.

7. A member with a dissenting opinion shall be entitled to attach a written opinion to the minutes of the deliberation.

Article 4. Openness of Dispute Resolution by Tsets

1. The dispute resolution process of Tsets shall be open and transparent. Except for exceptional circumstances requiring protection and confidentiality of the state, business/commercial information and privacy or safety of a citizen, the Tsets shall conduct open sessions.

2. Participants of an open session of the Tsets shall be allowed to make notes, tape recording, radio and TV live broadcasting, cinematic, photographic and video recording.

3. Citizens and legal entities have the right to make copies of decisions of the Tsets and notes of open sessions at their own expense.

Article 5. Oral Proceedings in Dispute Resolution

The explanations, conclusions, proposals, requests, and arguments of the disputing parties shall be heard orally and documents and materials required for delivering a decision and those requested by the parties shall all be read out loud.

Article 6. Language of proceedings

1. Proceedings of dispute resolution at the Tsets shall be conducted in the Mongolian language.

2. If a disputing party does not possess a good command of the Mongolian language, the Tsets shall provide an opportunity to speak and understand in the native language or any preferred foreign language through an interpreter. If witnesses, experts, and other specialists attending a session do not possess a good command of the Mongolian language they shall be granted the right to give their testimony, statement, conclusion or explanation in the native language or other preferred foreign language through use of services of an interpreter.

3. Minutes of a session of the Tsets, and all other documents shall be written in the Mongolian language and all foreign language documents shall be translated into the Mongolian language.

Article 7. Physical Presence in Conducting Examination and Dispute Resolution at the Tsets

1. A session examining and resolving disputes from their beginning to the end shall be conducted in the physical presence by the same composition of members appointed in accordance with the rules determined by law.

2. Nobody shall be entitled to remove a member appointed to the composition of the Tsets to examine and resolve a dispute from proceedings of examining and resolving disputes for the reasons other than justification and rules determined by law.

3. If a member appointed to the composition of the Tsets to examine and resolve a dispute is unable to continue due to a justified reason, the Tsets shall appoint another member of the Tsets and conduct the dispute resolution process newly from the start.

Article 8. Continuity of Procedure of Examining and Resolving Disputes by the Tsets

1. A session, as well as a deliberation of the Tsets shall be held continuously, with the exception of the time allocated for holidays as provided for in law.

2. A session of the Tsets may be adjourned only in cases such as necessity to call a witness, to appoint an expert, to collect new evidences, to appoint a new member of the Tsets to replace a member, who has become unable to continue working at the session.

3. It is prohibited to conduct examination of other disputes during the adjournment of a Tsets session.

4. If there arises a circumstance, which impedes the examination of a dispute at a given session, the session shall be deferred for a reasonable time necessary to eliminate the circumstance.

5. A session of the Tsets adjourned for the purpose of replacing a member of the composition, it shall recommence from the start. Replacement of other participants shall not prevent the composition to continue the session from the moment the circumstance impeding the normal course of the session has been eliminated.

Article 9. Adversarial Nature

1. Disputing parties, their authorized representatives, and advocates shall exercise their right to contest by questioning and receiving answers from one another on the subject of the dispute, mutually contend the evidence serving the grounds thereof, present facts and proofs to this effect as determined by appropriate rules.

2. The Tsets shall provide the disputing parties with the opportunity of free contestation.

Article 10. Confidentiality of Deliberations of the Tsets

1. Deliberation of the members on making decisions of the Tsets shall be held in a designated room.

2. Persons other than the members reviewing a dispute in a session and the secretary assigned to take notes of the deliberation shall be prohibited to enter the room in which the deliberation is being held. It is prohibited to disclose the opinion of members given in the deliberation room.

Article 11 Lawfulness and Justification of Decisions of the Tsets

1. A decision of the Tsets shall be delivered in the name of the Constitution of Mongolia.

2. A decision of the Tsets shall be accepted as lawful when it is fully compliant with the letter and spirit of the relevant provision of the Constitution, the Law on Constitutional Tsets, and this Law. The Tsets, and a member of the Tsets, may use as guidance provisions of other laws compliant with the provisions of the Constitution, and the Law on the Constitutional Tsets.

3. A decision of the Tsets shall be accepted as fully justified when all significant circumstances of a disputed matter are examined at the session comprehensively, completely and objectively and the conclusion is sufficiently supported by all evidence.

4. A final decision of the Tsets shall enter into force upon its issuance.

Article 12. Independence of Dispute Resolution

1. A member of the Tsets shall, in examining a constitutional dispute, be independent from any organization, public officials, and other citizens and be governed solely by the Constitution, and his /her own commitment.

2. A member of the Tsets shall not represent anyone in carrying out his/her official duty.

3. Public officials, citizens or any other entity are prohibited from interfering, pressuring or influencing in any form upon a member of the Tsets, while he/she exercises the duty of examining a constitutional dispute.

4. A member of the Tsets shall not be permitted to express his/her opinion in advance on disputes under examination or make recommendations to others in this respect.

Article 13. Jurisdiction

1. The Tsets shall consider and deliver a judgment, and, if necessary, reconsider the matter and make a final decision on the following disputes regarding the constitutionality of:

1/ law and other decisions of the State Great Hural;

2/ decrees and other decisions of the President of Mongolia;

3/ decisions of the government;

4/ international treaties to which Mongolia is a signatory party;

5/ decisions of the Central electoral body on referendums, and

elections of the State Great Hural, its members, and the

President.

2. The Tsets shall consider and deliver a judgment on acts of non-compliance with the Constitution of the following officials:

1/ the President of Mongolia;

2/ the Chairman of the State Great Hural;

3/ a member of the State Great Hural;

4/ the Prime Minister;

5/ a member of the Government;

6/ the Chief Justice of the Supreme Court;

7/ the Prosecutor General.

3. The Tsets shall consider and deliver a judgment on existence of grounds for the resignation or withdrawal of the following officials:

(This provision was added by the law 7 May 2020)

1/ the President of Mongolia;

2/ the Chairman of the State Great Hural;

3/ the Prime Minister;

4/ a Member of the State Great Hural.

4. If claims filed to the Tsets contain claims within jurisdictions of other courts and authorities, the Tsets shall make a judgment on the claim within its jurisdiction and refrain from resolving claims or parts of claims outside its jurisdiction. This shall not constitute an obstacle to action on claims or parts of claims by relevant courts and authorities.

Article 14. Determination of Jurisdiction

In the event of submission of complaints by citizens, public officials, governmental and non-governmental organizations to the Constitutional Tsets for determination of jurisdiction of legal disputes, rejected by all courts, the Tsets shall determine jurisdiction of legal disputes and refer to the relevant court.

Article 15. Scope of Proceedings of Examining and Resolving Disputes by the Tsets

1. The Tsets shall exercise supreme supervision over the implementation of the Constitution and deliver decision on disputes regarding non-compliance and breach of the Constitution.

2. The Tsets shall not deliver a decision under its jurisdiction on disputes concerning non-compliance and breach of laws other than the Constitution.

3. The Tsets shall institute proceedings of examining and resolving disputes only on the basis of petitions, notification and requests.

If a relevant authority or a public official restores directly or in effect provisions of laws and other decisions invalidated by a decision of the Tsets, the Tsets may examine and resolve through a compliance review initiated by a member of the Tsets.

4. The Tsets shall examine and deliver decision on disputes concerning the constitutionality of the legislation adopted and actions of officials occurring after the 12 February of 1992, the day the Constitution entered into force.

/ According to the 1st conclusion of the Constitutional Tsets dated April 15, 2020, "The Tsets shall examine and deliver a decision on disputes concerning the constitutionality of the legislation adopted and actions of officials occurring after the 12 February of 1992, the day the Constitution entered into force." has been suspended since April 15, 2020./

/ According to Resolution No. 30 of the State Great Hural of Mongolia dated April 24, 2020, the 1st conclusion of the Constitutional Tsets dated April 15, 2020, cannot be accepted./

Article 16. Submission of Petitions, Information and Requests to the Tsets

1. Citizens shall be entitled to submit a petition and information concerning breach of the Constitution; President, State Great Hural, Prime Minister, Supreme Court, and the Prosecutor General shall be entitled to submit requests regarding existence of substance of breach of the Constitution.

2. Apart from citizens of Mongolia, foreign citizens and stateless persons residing lawfully in the territory of Mongolia shall enjoy the right to submit petitions and information to the Tsets.

Article 17. Participants in Proceedings of the Tsets

1. The participants in proceedings of the Tsets shall be:

1) citizens, authorized officials, organizations originators of petitions, informations, and requests, which served as a ground for initiation of dispute proceedings of the Tsets, including organizations and public officials responsible for laws and other decisions or carried out activities that allegedly have breached the Constitution;

2) authorized representatives and advocates eligible due to their official position or appointed in accordance with the appropriate rules.

2. Authorized representatives to participate in proceedings of the Tsets shall be appointed in accordance with the rules stipulated in the provisions of the Civil Code Procedure Law.

Article 18. Rights and Responsibilities of Participants in the process of examination and dispute resolution by the Tsets

1. The participants in the proceedings of the Tsets shall enjoy equal rights within their respective competence.

2. The disputing parties shall have the right to review the materials of the dispute under examination, obtain copies of related documents, take notes, to present evidence, to participate in the examination of evidence, submit their proposals and conclusions on all issues emerging during the proceedings, freely contest in the session, deliver a closing speech, if deemed necessary, and make requests.

3. The participating parties shall have a right to object a Tsets composition and request removal from the composition on the grounds specified in the law.

4. The originators of a submitted petition, information, or a request to the Tsets shall have a right to modify arguments and basis of their claim, reduce or extend the dimension of the claim and withdraw in whole or partly at any stage of the proceedings before adjournment for final deliberation.

5. The participating parties shall be responsible to provide material proofs of the evidence and justification of arguments of their claim and objections to the counter claims and circumstance.

6. The participant in the process of examining and resolving disputes of the Tsets shall strictly adhere to the procedures of the Tsets session and be ruled by the judge chairing the session.

7. If a participant repeatedly violates the rules of the session, or presents false documents to the Tsets and its members, his/her actions shall be considered as a disrespect to the Tsets and shall be subject to liability as stipulated in an appropriate law.

Article 19. Expenses of the Process of Examining and Resolving Disputes by the Tsets

1. The expenses on witnesses, experts, specialists and interpreters participating in the process of examining and resolving disputes of the Tsets and other necessary expenses shall be defrayed by the state budget.

2. If a citizen, submitter of a petition or information, which served as grounds for initiating a process of examining and resolving disputes by the Tsets, is a local resident, the expenses related to his participation at the session of the Tsets shall be borne by:

1) organizations and officials responsible for adoption of the laws, decrees, and other decisions in breach of the Constitution and/or official, who breached the Constitution if the petition or notification have been determined as justifiable.

2) the citizen if the petition or information is determined as unjustified.

CHAPTER TWO.

INITIATNG A PROCESS OF EXAMINING AND RESOLVING DISPUTES BY THE TSETS AND PREPARATION FOR THE SESSION

Article 20. Submission of Petitions, Informations and Requests to the Tsets

1. Citizens, organizations and officials shall submit their petitions, information and requests in writing and shall include the following therein:

I/ name, address of residence and method of correspondence;

2I name, address, position, and other necessary information about the person to perform duties of an authorized representative or advocate;

3/ title date of adoption, and number of the legislation considered not compliant with the Constitution, as well as the name, address and actions of the official breaching the Constitution;

4/ grounds of a claim, other circumstances and proof of evidence;

5/ statement of point of view regarding the disputed issue;

6/ claims to be settled by the Tsets;

7I articles, sections and provisions of the Constitution and this Law justifying application to the Tsets;

8/ enclosed documents, list of relevant persons and current addresses.

2. Necessary documents include a power of attorney in the case of originators of a petition, information, or a request to be represented by an authorized representative in the process of examining and resolving disputes, as well as translations of enclosed documents written in a language other than the Mongolian language.

3. The Tsets shall not accept anonymous petitions, information, and requests.

Article 21. Receiving Petitions, information and Requests by the Tsets

1. Petitions, notifications, and requests submitted by citizens, organizations, and officials to the Tsets shall be distributed for examination to its member by the Chairman of the Tsets.

2. The member who received petitions and information concerning a breach of the Constitution from citizens shall carry out the initial examination within 14 days and deliver a decision on initiating a process on his/her own initiative.

3. The member of the Tsets, who received requests from authorized organizations and officials, shall initiate a dispute resolution process immediately upon their receipt.

4. Complaints against a decision of a member of the Tsets on initiating/not initiating a process of examining and resolving disputes by the Tsets raised by disputing parties or proposed by a member of the Tsets, in writing, shall be considered by a session of a 3-member bench appointed by the Resolution of the Chairman of the Tsets, to deliver a decision and certification of decision on the eligibility of the matter for initiating a process of examining and resolving disputes.

5. The member of the Tsets shall upon initial examination of petitions and information from citizens and issue a resolution to refrain from initiation of the process of examining and resolving disputes under the following grounds:

I/ the petitions and information did not meet the requirements described in Section 1, Article 20 of this Law;

2/ the person submitting a petition or information is not authorized to address to the Tsets;

3/ claims in the petitions and/or information do not fall within the jurisdiction of the Tsets;

4/ previous judgment and/or resolution delivered by the Tsets on a given dispute are in force;

Article 22. Exclusion of a Member of the Tsets

1. Exclusion of a member of the Tsets from the process of examining and resolving disputes shall be prohibited on the grounds other than those described in this Law.

2. A member of the Tsets shall be excluded from the process of examining and resolving disputes on the following grounds:

I/ if he/she has taken part with a voting right in adopting a legislation, and ratification of international treaties to which Mongolia is a party are under consideration;

2/ if less than 2 (two) years have passed since he/she has taken part in making decision on the disputed matter through other juridical or administrative bodies;

3I if he/she is closely related to the disputing party members or their representatives;

(This provision was amended by the law of 2 June 2004)

3. A member of the Tsets shall disclose existence of grounds described in Section 2 of this Article and withdraw from the process of examining and resolving disputes.

4. The issue of withdrawal of a member of the Tsets from the process of examining and resolving disputes shall be considered at a closed session of the Tsets and the decision shall be documented.

5. If a member of the Tsets, who examined the dispute, withdraws from the process, the Tsets shall recommence the process of examining and resolving disputes from the start.

If the participation of other members of the Tsets in a session rejected, the session shall be recommenced from the start.

Article 23. Preparation for the Session of the Tsets

A member examining a dispute through the process of examining and resolving disputes shall carry out the following for consideration at the session of the Tsets:

1/ deliver copies of the petitions, information and requests to the disputing parties, and a notification to appoint authorized representatives to take part in the process of dispute;

2I inform the disputing parties the rights and responsibilities provided for in this Law to the disputing parties, and assist with presenting new proof of evidence to the Tsets;

3/ question and obtain explanation, comments and definitions from the disputing parties and their authorized representatives;

4/ obtain all relevant data and demand to produce other information of significance to the resolution of the dispute;

5/ question and obtain characterization from public officials and other persons related to the dispute;

6/ If deemed necessary, appoint professional analysts, expert scientists and acquire expert statements;

7I obtain testimony from witnesses;

8/ combine two or more petitions, information and requests into one issue, and issue a resolution on separation of two or several claims put forth in one petition, notification, or request;

9/ issue a resolution on withdrawal of the process of examining and resolving disputes if the disputing parties arrive to a mutual understanding resulting in a voluntary withdrawal of the petition, notification and request by the originator.

10/ based on the analysis of collected documentation and evidence, prepare a draft outline of the introduction and statement of the dispute sections of a decision of the Tsets session;

11/ other prerequisite preparations required for a complete and reasonable resolution of the dispute;

4. The preparation for the session shall be carried out within 30 days from the start of the process of examining and resolving disputes and, if complexity of the dispute requires, the Chairman of the Tsets may grant of an extension period of up to 30 days.

5. The preparation for examining and resolving a dispute related to the declaration of a state of emergency, war or move of military force shall be completed within 3 days.

6. The Chairman of the Tsets shall be entitled to appoint two or more members by a resolution for the preparation of a session to review the issues of special challenge and immediate settlement.

5. Organizations, public officials and citizens shall be responsible for presenting documents demanded by the member of the Tsets in a timely manner.

Article 24. Announcement of a Tsets Session

1. Upon completion of the preparatory stage of examination of a dispute, the member of the Tsets shall issue a resolution for transferring a dispute for consideration by a session of the Tsets.

2. The session of the Tsets shall be open. Matters concerning military defense or national security, information of the state, private entities and individuals protected by law shall be considered at a closed session and notice shall be made in the resolution for transferring a dispute to the session of the Tsets.

3. A member of the Tsets shall set and announce with the counsel of the Chairman of the Tsets the time, date, and venue of the session, open or closed session status in the major national media 7 days prior to the session, except the cases stipulated in Section 3 of Article 23 of this Law.

4. The disputing parties, witnesses, experts and other participants shall be formally notified of the date, time and venue of the session.

CHAPTER THREE.

RESOLVING DISPUTES AT THE SESSION OF THE TSETS

Article 25. Paying Respect to the Tsets Session

1. A session of the Tsets shall be held in a hall where the State emblem and flag are honorably placed.

2. Participants in the session shall rise to honor members of the Tsets entering a session.

3. Members of Tsets shall wear the official gown of the Constitutional Tsets.

Article 26. Opening of the Tsets Session

1. The session shall be held by a composition consisting of a presiding member and members appointed by the resolution of the Chairman of the Tsets.

2. At the start of a session, the secretary shall report on the attendance of the disputing parties, witnesses, analysts, experts and translators.

3. The member presiding the session shall open it and announce the issues to be considered.

4. The member presiding the session shall explain the rights, duties, responsibilities of the disputing parties.

5. The member presiding the session shall introduce the composition of the Tsets to resolve the dispute.

6. The member presiding the session shall inquire and resolve proposals by the disputing parties regarding participation of witnesses, appoint of experts, presenting of new evidences, and withdrawal of a member from the composition of the session should this be requested.

7. If it is deemed necessary by the member presiding the session, he/she may request a witness to vacate the session premises.

8. The member presiding the session shall explain the order and rules of the Tsets session, and remind the disputing parties and the audience of their duty to abide by.

Article 27. Consequence of Non-attendance of a Disputing Party

1. The reasons for absence of the disputing party, witness, expert and/or translators shall be clarified.

2. A session of the Tsets shall not be postponed, if a formal notification of the date, time and venue of the session has been delivered and an absentee has not filed a written statement explaining reasonable grounds for absenteeism or has filed a written statement formally consenting to resolution of the dispute in his/her absence.

3. A session of the Tsets shall be postponed, if a disputing party is unable to attend due to reasonable grounds and has formally stated his/her will to be present in person in the dispute resolution. Decision to adjourn a session shall be recorded a written form, which shall contain the date, time and venue of the next session or decision to announce if these arrangements are not made at the time of postponement.

4. In case of the absence of a witness, expert or interpreter, the issue shall be discussed and resolved as such cases arise.

Article 28. Resolution of Disputes by the Tsets Session

1. The process of consideration of a dispute for resolution shall commence with a report presented by the member of Tsets responsible for the preparatory analysis of the dispute.

In the report, the member of the Tsets shall present the substance of the dispute and related proof of evidence without imparting his/her own judgment and recommendations.

2. After hearing of the member's report the disputing parties shall present additional explanation, if any, starting from the party which submitted the petition, request, or notification.

3. The session shall hear the witness testimony and conclusions made by experts and analysts and the order of hearing shall be determined by the member presiding the session given the specifics of each dispute.

4. The disputing parties shall litigate at the session and the member chairing the session shall determine the order of litigation.

5. Any member of the Tsets composition, with the permission of the member presiding the session, shall have the right to question and receive answers from any participant at any stage of the session. Questions of a member of the Tsets may not be in the form of preliminary conclusions or debates.

6. Upon completion of the process of examining evidence, litigation, cross-examination and hearing witness testimony of the disputing parties the session shall hear proposals and closing speeches by the disputing parties.

7. The Tsets session shall deliver and document in a written record a decision to separate or merge the subject of disputes during the process of the session of the Tsets.

Article 29. Consultation of the Tsets on making a decision

1. The Tsets shall deliberate and deliver a decision in a room for consultation. One of the members participating in the session shall write down the decision.

2. Members of the Tsets present in the consultation and participating in the session shall exercise equal rights in the resolution of a dispute and shall enjoy the right to freely express and explain their opinions and positions.

3. Members participating in a session of the Tsets shall deliberate on the final decision at a closed session held in the room for consultation. The member, who presented the opening report, shall present his/her judgments and recommendations first followed by presentation of judgments and recommendations in seniority order beginning with the most senior member, and the chairperson shall be the last one to impart his/her judgment.

4. A member participating in a dispute resolution session of the Tsets shall impart his/her recommendation for the decision in the room for consultation.

5. A final decision delivered in the room for consultation shall be signed by the member presiding the session and each participating member, and the presiding member or a participating member appointed by the member presiding the session shall read out the decision to the audience.

6. If the votes of participating members divide, or additional investigation on the dispute is needed, the Tsets shall deliver and document a decision to adjourn the session and resume for resolution of the dispute within the next 30 days.

Article 30. Reconsideration of Disputes

1. A dispute shall be reconsidered completely resuming from the preparatory stage on the following grounds:

1) State Great Hural refuses to accept the judgment of the Tsets;

2) the majority of the members of the Tsets rules to reconsider a previously resolved dispute;

3) a new circumstance arises;

2. The Chairman of the Tsets shall issue a resolution to reconsider a dispute.

3. The procedure of resolving a dispute stipulated in this Law shall rule the process of reconsideration of a dispute. A member of the Tsets, who examined the dispute in the previous round, shall not re-examine it.

CHAPTER FOUR.

DECISION OF THE TSETS

Article 31. Forms of Decisions of the Tsets

1. Decisions of the Tsets shall be delivered in the form of a judgment, resolution or certification.

2. The Tsets shall issue a judgment on the disputes described in Section 1, 2, 3, of Article 13 of this Law; a resolution on a reconsidered dispute described in Section 1 of the same article; and a certification on disputes described in Section 4 of Article 21 of this Law and on disputes resolved by the medium and full bench sessions.

Article 32. Decision Procedure of the Tsets

1. The Tsets shall deliver a decision to fully repudiate or qualify claims of a petition, information and request or repudiate parts of a claim. The decision shall be based on facts and evidence proved in the process of a session.

2. A decision of a session of the Tsets shall be adopted by a majority vote of the members participating in the session; the resolution delivering a decision of a reconsidered dispute shall be adopted by the 2/3 vote of the members participating in the session.

3. The decision of the Tsets shall be read out immediately upon its adoption.

4. Upon delivery by the Tsets of a judgment constitutionally invalidating a law, decree, other decisions of the State Great Hural, international treaties of Mongolia and related articles, these shall be suspended and remain suspended until a final decision is delivered. The Tsets shall determine separately the effective date of such suspension.

Article 33. Content of Decisions of the Tsets

A decision of the Tsets shall include:

1) the title, date, time, place of its adoption;

2) names of the member presiding the session, participating members, and the secretary;

3) names of the disputing parties, their authorized representatives, advocates, interpreters, witnesses, experts;

4) names of the persons submitting a petition, information and request, and substance of claims;

5) articles, sections, provisions of the Constitution, Law on the Constitutional Tsets and this Law applied in resolving the dispute;

6) name, address, position of the officials whose action and decision is claimed to be in breach of the Constitution;

7) circumstances determined by the examination and dispute resolution session of the Tsets;

8) grounds for the decision of the Tsets, conclusion on documents and proof of evidence;

9) articles, sections, and provisions of legal acts applied as guidance in making the decision of the Tsets;

10) status of dispute resolution by the Tsets.

Article 34. Public Announcement of Decisions of the Tsets

1. The brief contents of the decision of the Tsets shall be announced to the public immediately upon delivery through media. Content of sections of decisions delivered at closed sessions shall be announced to the public.

2. The full text of decisions delivered by open sessions of the Tsets shall be published in the "State Information" magazine.

Article 35. Record of Sessions of the Tsets

1. Every word of the process of a dispute resolution session of the Tsets shall be recorded throughout its duration.

2. The records of a session shall include:

1)/ date, place and time at which the session began and ended;

2) names of the presiding member, participating members and the secretary;

3) names and occupations of the disputing parties and other participants;

4) substance of the dispute resolved;

5) process of the session;

6) testimony, explanations, conclusions, requests, questions and answers of the disputing parties, their representatives, witnesses and experts;

7) oral decisions made on some issues in the course of the session;

8/ other;

3. The secretary shall take notes of the consultation separately.

4. Technical equipment shall be applied to record the total process of the session and the notes shall be completed and filed with the case records within one week.

5. The member presiding the session and the secretary shall sign the notes of the session.

Article 36. Implementation (Enforcement) of Decisions of the Tsets

1. The decision of the Tsets shall be delivered to the State Great Hural, President, Government, Ministry of Justice, the disputing parties and the "State Information" magazine.

2. The State Great Hural shall settle a judgment of the Tsets within 15 days upon its receipt, if a judgment is delivered during the parliamentary recess and is not a matter related to declaration of a status of emergency or war, the State Great Hural shall act upon it within 15 days from the start of its next session in accordance with the Article 27 of the Law on the Rules of the State Great Hural Session.

3. If the decision of the Tsets is rejected by the State Great Hural, the Tsets shall reconsider the entire dispute from the start by a full bench composition. If the grounds for rejection by the State Great Hural are confirmed, the Tsets shall deliver a resolution annulling its judgment and shall issue a resolution annulling the resolution of the State Great Hural if the grounds for rejection are not confirmed by its full bench session.

4. A law pronounced unconstitutional by the final decision of the Tsets shall be invalided upon the issuance of its resolution.
